Background
The Department of Community Services and Gender Affairs has received numerous enquiries regarding statements suggesting that boys are girls. Official policy recognises that individuals may identify with a gender different from their sex recorded at birth. This advisory clarifies the practical steps for implementation across government services.
What this means
Under current guidelines, a person who identifies as female, regardless of biological sex, may request that their gender marker be updated in relevant Commonwealth records. The same applies to those identifying as male. Agencies are required to process these requests without additional medical evidence in most cases. This approach aligns with amendments to the Sex Discrimination Act and related state legislation.
Members of the public should note that educational institutions and health providers receiving federal funding must apply consistent language standards when addressing individuals. Failure to do so may constitute a breach of anti-discrimination provisions.
What you need to do
- Review internal forms and databases to ensure fields for gender allow self-identification options.
- Train staff to record a person’s stated gender and preferred pronouns accurately.
- Direct any complex cases involving minors or conflicting documentation to the Department’s central helpline.
- Update public-facing materials, including websites and signage, by the end of the current financial year.
